1. Introduction

These Terms and Conditions govern your access to and use of this website, as well as the purchase of any goods from MAD Safety. By browsing the website, creating an account, or placing an order, you agree to be bound by these Terms in their entirety. If you do not agree to these Terms, you must cease using this website immediately.

2. Definitions

“MAD Safety”, “we”, “us”, or “our” refers to the business operating as MAD Safety Pty Ltd.

“Goods” refers to the safety products, equipment, and related items offered for sale on the website.

“Website” refers to the online platform operated by MAD Safety.

“You” or “your” refers to the user of the website and/or the purchaser of the Goods.

3. Website Use and Intellectual Property

All content, images, product descriptions, and materials on this Website are the intellectual property of MAD Safety or its licensors. You may not reproduce, distribute, or modify any content without our prior written consent. You agree to use the Website only for lawful purposes and are prohibited from transmitting any malicious software, engaging in fraudulent activities, or taking any action that disrupts the functionality of the Website.

4. Pricing and Orders

All prices listed on the Website are in Australian Dollars (AUD). We reserve the right to amend prices at any time without prior notice; however, such changes will not affect orders that have already been confirmed.

The display of Goods on the Website constitutes an invitation to treat. An order submitted by you is an offer to purchase the Goods. We reserve the right to accept, reject, or cancel any order for any reason, including but not limited to the unavailability of Goods, errors in pricing or product descriptions, or suspected fraudulent activity. If an order is cancelled after payment has been processed, a full refund will be issued.

5. Payment and Title

Payment must be made in full at the time of placing an order unless you hold an approved commercial credit account with MAD Safety, in which case specific account payment terms will apply. Ownership and title to the Goods will not pass to you until we have received payment in full. Risk of loss or damage to the Goods passes to you upon dispatch to the nominated delivery address.

6. Delivery and Freight

MAD Safety coordinates the dispatch of Goods from our operations in Geelong, Victoria, utilizing third-party delivery agents. While we strive to ensure prompt dispatch, any delivery timeframes provided are estimates only. MAD Safety is not liable for any loss, damage, or expense incurred due to delays in delivery caused by third-party carriers or unforeseen circumstances. Additional freight charges may apply for oversized, bulky items, or deliveries to remote locations.

7. Returns and Warranties

Our Goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the Goods repaired or replaced if the Goods fail to be of acceptable quality and the failure does not amount to a major failure.

In addition to your statutory rights, MAD Safety products may carry a standard manufacturer’s warranty covering defects in materials and workmanship. This warranty does not cover damage resulting from normal wear and tear, misuse, unauthorized modification, or failure to follow installation and care instructions.

8. Limitation of Liability

To the maximum extent permitted by law, MAD Safety excludes all liability for any direct, indirect, incidental, special, or consequential loss or damage (including loss of profits, revenue, or data) arising out of or in connection with your use of the Website, the purchase of the Goods, or the reliance on any information provided on the Website.

9. Indemnity

You agree to indemnify and hold harmless MAD Safety, its directors, employees, and agents from any claims, losses, liabilities, damages, or expenses (including legal fees) arising from your breach of these Terms or your misuse of the Website or Goods.

10. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of Victoria, and any legal proceedings may be heard in Geelong or the appropriate regional registry.

11. Amendments

MAD Safety reserves the right to update or modify these Terms at any time. Any changes will be effective immediately upon being posted to the Website. Your continued use of the Website following any such amendments constitutes your acceptance of the revised Terms.
